Are Livingston Parish Court Records Public?

Generally speaking, court records for Livingston Parish are public under the Louisiana Public Records Act and the Rules of Court regarding the conduct of court proceedings. Thus, most records (i.e., filings) made in civil, criminal, probate, and other property-related matters may be viewed by the public either in person at the Clerk’s Office or, in certain situations, via an online access system. Public access to court records is intended to provide transparency and accountability in the operation of the judicial system.

However, not all records are available to the public without restriction(s). There are specific case type(s) or portions of a file which are restricted from disclosure by statute to protect the privacy and/or sensitive information of parties to the proceeding. Examples include: juvenile proceedings; adoption proceedings; certain family law proceedings; and records involving minor children.

Livingston Parish Court Records Search

Access to records in the Clerk of Court’s Office in Livingston Parish is provided in one of three ways, depending on the type of matter and how much detail you wish to know about it.

Searching Online: Most records may be searched through the parish clerk of court’s online case management system. The system allows users to search by party name, case number, or filing date. However, availability may be limited - civil, criminal, and property cases typically will be available, but certain family or juvenile cases may not be visible online (due to confidentiality). Also, some systems may require you to register an account to use them or pay a per-document viewing fee.

In-Person Searching: If you need to view records in person, you may do so at the clerk of court’s office using the public access terminals. Although staff may help you locate your file, they are not permitted to give you legal advice. Additionally, you may obtain copies of the documents for a per-page copying fee.

By Mail and Telephone: You may submit requests by mail that include your case information, applicable copying fees, and a self-addressed, stamped envelope. You may contact the clerk of court’s office by telephone to verify costs, acceptable forms of payment, and estimated time frames for completing your request.

Criminal Records Access in Livingston Parish

Official, complete criminal history background check results are not produced by the courts located within Livingston Parish; however, official statewide criminal history reports are prepared and maintained by the Louisiana Department of Public Safety & Corrections or the Louisiana State Police, which also serves as a central repository for all criminal history data in the state of Louisiana. The reports provided by the state police are generally used for employment screenings, license applications, or background checks.

The records found at the local (parish) level of the courts, specifically those pertaining to Livingston Parish, detail the case file of the specific case(s) filed in the parish, including charging documents, dates of court appearances, plea entries, and the result of the sentencing from the case(s). To find information on a specific case file, members of the public may either access the case file information via the parish clerk of court’s website, if the parish has made it available, or they may visit the clerk of court’s office in person to manually locate the case file information.

Livingston Parish Probate Records

Beginning with the documents available from the Probate Court of Livingston Parish, you may determine how a person’s property and/or legal affairs were dealt with at their death, or if they became mentally incapacitated, by looking at what was done with that person’s property, or how someone else’s legal affairs were managed due to them being incapacitated.

The Clerk of Court in each parish acts as the "custodian" of all official documents filed into the record of the District Court. Common examples of probate records that would be located in the Clerk of Court’s office would include:

  • Last Will and Testament that was submitted for probate.
  • Petitions to Open Succession (Estate Administration)
  • Inventory of Estate Assets
  • Court Orders Appointing Executor(s) or Administrator(s)

In cases where minors or incapacitated adults have been involved, Guardianship or Conservatorship Petitions may detail who has been appointed to make the decision regarding that minor/incapacitated adult’s finances and/or personal life.

While some more recent filings may be searched via the Clerk’s Online Portal (as long as the system is available), many older files or complete case packets may need to be requested in person. Some probate matters, especially those involving minors, mental health issues, etc., and/or sealed court orders, may be restricted or confidential as per state statute.

Livingston Parish Family Court Records

Livingston Parish family court records detail the legal processes of divorce, child custody, child/spousal support, and adoptions. The clerk of court in each parish maintains all of these records as part of the district court system and documents all filings, motions, orders, and final judgments in the family law case.

All of these records are typically open to the public; however, some sensitive information may be limited to authorized access (such as in an adoption case) or sealed (in cases involving minors). As long as you have access to the Internet, many recent filings in family law cases are now searchable via the clerk’s case management system. Using this service, you may see the case summary, hearing date(s), and a basic listing of documents.

To get a more detailed record or a certified copy of one of the above-mentioned records, you should contact the courthouse in person. The staff at the courthouse typically helps searchers find the records they want and processes their request. A certified copy requires you to file a formal application and pay the cost associated with requesting the copy of the record. Typically, there is a charge for each page and a separate fee for certifying the document. Some clerks may accept mail requests for certified copies, provided you include all required documentation and the proper amount to cover the costs of the request.
